Using Our Platform: Our platform allows users to create and customize their own cards, from designing unique card visuals to crafting personalized attributes. When you use our Service, you will have access to a variety of templates provided by us.

User Content: You have the option to upload your own content, such as images, logos, and other elements (“User Content”), which you retain full ownership and responsibility over. You can use provided content, your User Content, and the design tools available on our platform to create your custom designs.

Platform Availability: Our Service is accessible through our website. By using the Service, you agree to comply with these Terms of Use, and you acknowledge that you have read and understood our Privacy Policy.

Eligibility: You may only use our Service if you are legally permitted to do so under applicable laws. By using the Service, you represent and warrant that you have the full right, power, and authority to agree to these Terms and to fully perform all obligations outlined herein.

Age Requirement: Children may not access or use the Service unless their use is explicitly authorized by a parent, guardian, or another authorized adult (such as a teacher) who agrees to be bound by these Terms. For the purposes of these Terms, a child is defined as a person under the age of 13 (or the minimum legal age required to consent to the processing of personal data in their country). If you are an adult authorizing a child to use the Service, you take full responsibility for their use, including ensuring compliance with these Terms.

Access to the Service: Subject to your compliance with these Terms, you are granted a non-exclusive, limited, non-transferable, and revocable license to access and use the Service for personal or non-commercial purposes. We reserve all rights not expressly granted under these Terms.

Acceptable Use Policy: Your use of the Service, including your User Content and Designs, must comply with our Acceptable Use Policy. Violations of the policy may result in the removal of infringing content, suspension with immediate effect. Prohibited activities include but are not limited to creating designs that infringe on the intellectual property of others or contain inappropriate, offensive, or harmful material.

Anti-Discrimination Policy: We do not support or tolerate the use of our Service to engage in or promote discrimination against any individual or group based on race, religion, sex, sexual orientation, age, disability, ancestry, or national origin. You are strictly prohibited from using the Service in any way that incites, promotes, or supports hostility, violence, or discriminatory behavior.

Data Collection: When you use our platform, we collect the following types of data:

Design Data: If you choose to share your card in our gallery, we store the design and text from your card in our database to display it publicly.

Order Details: When you place an order, we collect your contact information, including your name, address, and email, to process and ship your order.

We do not collect or store payment information. Payment transactions are securely handled by our payment partner, Stripe, in compliance with industry-standard security measures.

Data Usage: Your data is used to provide our services, including saving and displaying shared card designs, processing orders, and improving our platform. We use Google Analytics to track website traffic and user interactions to enhance our services. This involves the collection of anonymized usage data but does not include personally identifiable information.

Public Content: If you choose to share your custom card in our gallery, it will be publicly visible to other users. By publishing your card, you agree that the design and it's associated text may be displayed publicly in accordance with our Terms of Use. If you later decide to remove your card, you can report it, and we will review the request for deletion.

Data Access and Deletion: Users do not have direct access to their stored data through the platform. If you wish to request the deletion of publicly shared content, you may report it for review, or contact us by email through our contact page. We reserve the right to retain order and contact details as required for legal and operational purposes.

User Content. You represent and warrant that you own all rights, title, and interest in and to your User Content or that you have otherwise secured all necessary rights in your User Content as may be necessary to permit the access, use and distribution thereof as contemplated by these Terms. You grant Poke Card Generator a royalty-free and sublicensable license to display, host, copy, store and use your User Content solely to the extent necessary to provide the Service to you.

When you upload content to Poke Card Generator, you’re guaranteeing that you have the rights to it. We never obtain any ownership over your content, but we do need you to give us certain rights to store it and have it ready for you to use in your designs.

Sharing and Publishing Your Designs. You may publish or share Designs with others within the Service, via a Third Party Service, or via a link. Poke Card Generator maintains no responsibility in relation to such sharing of Designs and Poke Card Generator’s enablement of such activity or the Service’s performance of actions to publicly share Designs at your instruction shall not be considered a violation of any of Poke Card Generator’s obligations under these Terms.

Printing Your Designs

You can use our Service to print your custom Pokémon card designs. Print services are available in select locations and are subject to fees and applicable taxes, which will be specified at the time of placing your print order.

Print services are provided by third-party printing partners, who are responsible for producing your print orders. Please note that print orders may be affected by factors outside our control, such as shipping delays or unforeseen circumstances. While we strive to provide accurate delivery estimates, these times are not guaranteed.

If you encounter an issue with your print order, please contact our Support Team for assistance. However, we are unable to offer refunds or replacements for errors resulting from incorrect information provided by you or if you change your mind after placing an order.

Our website may feature content owned or provided by third parties. The inclusion or display of such content does not constitute an endorsement, sponsorship, or affiliation with those third parties. Any third-party content is governed by the terms and conditions of its respective owner or provider, and we are not responsible for its accuracy, reliability, or legality.

While we make every effort to ensure the information on our website is accurate and reliable, we do not guarantee its completeness, accuracy, or suitability for any purpose. By using our website, you acknowledge that you do so at your own risk. To the fullest extent permitted by law, we disclaim liability for any direct, indirect, incidental, or consequential damages arising from your use of the website or reliance on its content.
